Terms & Conditions – Scene By Studio (Drone Photography & Videography Services)

1. Introduction

These Terms & Conditions (“Agreement”) govern all services provided by Scene By Studio (“the Photographer”, “we”, “our”, “us”) to the client (“the Client”, “you”). By booking or engaging our drone photography, videography, or editing services, you agree to these Terms & Conditions in full.

2. Services Provided

Scene By Studio provides professional drone and ground-based photography and videography services, including:

  • Aerial imagery for commercial real estate listings

  • Progress and marketing videos for construction and development projects

  • Visual content for advertising, social media, and promotional materials

All flight operations comply with Civil Aviation Safety Authority (CASA) regulations and are subject to weather, safety, and airspace conditions.

3. Booking and Payment Terms

  • A 50% deposit is required to secure a booking unless otherwise agreed in writing.

  • The remaining balance is due upon delivery of the final edited files unless otherwise agreed in writing.

  • Cancellations made less than 24 hours before the scheduled shoot may incur a cancellation or rescheduling fee.

  • Delays caused by weather, restricted airspace, or safety considerations may result in rescheduling at no fault of Scene By Studio.

4. Access and Permissions

  • The Client is responsible for ensuring lawful access to all sites and obtaining any necessary property owner or site manager permissions prior to filming.

  • For construction sites, the Client must confirm that the location is safe to access and that appropriate site inductions and safety requirements are met.

  • Scene By Studio reserves the right to refuse or postpone operations if conditions are deemed unsafe or non-compliant with CASA or Work Health and Safety (WHS) standards.

5. Deliverables and Turnaround

  • Final edited images and/or videos will be delivered via secure digital download or other agreed delivery methods.

  • Standard delivery timeframe is 7 business days following completion of the shoot, unless otherwise specified.

  • Rush delivery options may be available for an additional fee.

6. Copyright and Licensing

  • Copyright Ownership: All photographs, videos, and other creative materials produced by Scene By Studio remain the intellectual property of Scene By Studio and are protected under the Copyright Act 1968 (Cth).

  • License to Client: Upon full payment, the Client of commissioned work is granted a non-exclusive, perpetual, worldwide license to use the delivered content for commercial purposes, including marketing, real estate listings, social media, advertising, print, and online publication.

  • Restrictions:

    • The Client may not sell, resell, transfer, or sublicense the content to third parties without prior written consent.

    • The Client may not claim authorship or remove embedded metadata or watermarks without permission.

  • Moral Rights: Scene By Studio retains the right to be credited as the creator wherever reasonably possible.

6A. Commercial Stock Footage and Stock Images

  • Where Scene By Studio provides photographs, video footage, aerial footage, or other visual content designated or licensed as commercial stock content, copyright and all intellectual property rights in that content remain with Scene By Studio unless otherwise agreed in writing.

  • Upon payment of the applicable licence fee, the Client is granted a non-exclusive, perpetual, worldwide commercial licence to use the licensed stock footage or images for legitimate commercial purposes, including advertising, marketing, websites, social media, real estate promotion, corporate communications, presentations, publications, and other promotional materials.

  • Unless expressly agreed otherwise in writing, the commercial stock licence:

    • does not transfer copyright or ownership of the content to the Client

    • does not grant the Client exclusive rights to the content;

    • does not permit the Client to resell, redistribute, sublicense, or make the content available as stock or downloadable content to third parties;

    • does not permit the Client to use the content in a manner that is defamatory, unlawful, misleading, or reasonably likely to imply endorsement by a person, business, brand, organisation, or other third party depicted in the content; and

    • does not include rights that may separately be required from identifiable persons, property owners, trademark owners, or other third parties appearing in the content.

  • Where stock content contains identifiable people, private property, trademarks, logos, artwork, brands, signage, or other third-party intellectual property, the Client acknowledges that the licence granted by Scene By Studio relates only to the rights owned or controlled by Scene By Studio. The Client is responsible for obtaining any additional permissions, releases, clearances, or licences required for the Client's particular intended use.

  • Unless expressly stated otherwise, stock footage and images are supplied as-is, and Scene By Studio does not warrant that third-party rights, releases, or clearances have been obtained for every possible commercial use.

6B. Editorial Footage and Incidental Trademarks, Logos and Third-Party Material

  • Scene By Studio may provide footage or images intended for editorial, documentary, news, public-interest, or informational purposes that incidentally contain trademarks, logos, brand names, uniforms, police or emergency-service insignia, government insignia, business signage, vehicles, artwork, buildings, or other third-party intellectual property.

  • The Client acknowledges that such third-party material may appear incidentally and is not necessarily owned, licensed, or cleared by Scene By Studio.

  • Editorial footage containing such material may be used by the Client for legitimate editorial, documentary, news, public-interest, informational, or reporting purposes, subject to applicable law and the terms of the relevant licence.

  • Unless expressly agreed in writing, the Client must not use editorial footage containing third-party trademarks, logos, insignia, or other protected material for advertising, sponsorship, product endorsement, commercial promotion, or any use that could reasonably imply that the relevant person, police or emergency service, government body, business, brand, or trademark owner endorses, sponsors, or is affiliated with the Client or the Client's products or services.

  • The Client acknowledges that the presence of a trademark, logo, police insignia, government emblem, business name, or other third-party material in editorial footage does not constitute an endorsement, affiliation, or authorisation by that third party.

  • Where the Client intends to use editorial footage for a purpose outside the permitted editorial or informational use, the Client is responsible for obtaining any additional permissions, releases, trademark clearances, location releases, or other rights required for that intended use.

  • Scene By Studio does not warrant that editorial footage is cleared for every possible commercial use where third-party rights are visible or identifiable.

6C. Third-Party Rights and Client Responsibility

  • The Client acknowledges that Scene By Studio can only grant rights in material that it owns or is authorised to license. Where content incorporates material belonging to or associated with third parties, including trademarks, logos, people, private property, artwork, music, government insignia, police insignia, or other protected material, any rights held by those third parties remain unaffected.

  • The Client is responsible for determining whether its intended use of the delivered content requires additional consent, clearance, release, licence, or other authorisation from a third party.

7. Safety and Compliance

  • Drone operations will only proceed under conditions that comply with CASA regulations, including controlled airspace and line-of-sight restrictions.

  • Scene By Studio reserves the right to cancel or adjust flight plans due to weather, proximity to airports, or safety risks.

  • The Client acknowledges that safety takes precedence over specific shot requests.

8. Revisions and Additional Editing

  • One round of reasonable revisions or colour adjustments is included in the agreed project fee.

  • Additional editing, revisions, or alternate versions requested after delivery may incur an additional charge at our standard hourly rate.

9. Limitation of Liability

While every effort is made to deliver high-quality results, Scene By Studio is not liable for:

  • Delays caused by weather, regulatory restrictions, or third-party permissions

  • Loss or damage arising from equipment failure or flight cancellation

  • Indirect, incidental, or consequential losses related to the use of delivered content

The total liability of Scene By Studio under this Agreement shall not exceed the total amount paid by the Client for the specific project.

10. Confidentiality

All project information, footage, and materials shared by the Client are treated as confidential and will not be disclosed or reused without written consent, except for standard promotional purposes (e.g. portfolio, website, or social media use) unless otherwise requested in writing.

11. Governing Law

This Agreement is governed by the laws of Queensland, Australia, and any disputes shall be resolved in the courts of that jurisdiction.

12. Acceptance of Terms

By booking or engaging Scene By Studio, you acknowledge that you have read, understood, and agree to these Terms & Conditions.

1. Services
Scene By Studio provides aerial photography, videography, and related media services. All bookings, pricing, and deliverables are subject to written agreement and confirmation.

2. Intellectual Property
All imagery, video, and creative content produced by Scene By Studio remain the intellectual property of the studio unless otherwise agreed in writing. Clients are granted usage rights according to their service agreement.

3. Client Responsibilities
Clients are responsible for obtaining any necessary permissions for aerial operations, property access, or filming subjects, unless explicitly arranged by Scene By Studio.

4. Limitation of Liability
While we take the utmost care in our operations, Scene By Studio is not liable for any indirect, incidental, or consequential damages arising from the use of our services or website.

5. Policy Updates
These terms and our privacy policy may be updated periodically. Continued use of our website or services indicates acceptance of the latest version.
