Terms & Conditions – Scene By Studio (Drone Photography & Videography Services)

1. Introduction

These Terms & Conditions (“Agreement”) govern all services provided by Scene By Studio (“the Photographer”, “we”, “our”, “us”) to the client (“the Client”, “you”). By booking or engaging our drone photography, videography, or editing services, you agree to these Terms & Conditions in full.

2. Services Provided

Scene By Studio provides professional drone and ground-based photography and videography services, including:

  • Aerial imagery for commercial real estate listings

  • Progress and marketing videos for construction and development projects

  • Visual content for advertising, social media, and promotional materials

All flight operations comply with Civil Aviation Safety Authority (CASA) regulations and are subject to weather, safety, and airspace conditions.

3. Booking and Payment Terms

  • A 50% deposit is required to secure a booking unless otherwise agreed in writing.

  • The remaining balance is due upon delivery of the final edited files unless otherwise agreed in writing.

  • Cancellations made less than 24 hours before the scheduled shoot may incur a cancellation or rescheduling fee.

  • Delays caused by weather, restricted airspace, or safety considerations may result in rescheduling at no fault of Scene By Studio.

4. Access and Permissions

  • The Client is responsible for ensuring lawful access to all sites and obtaining any necessary property owner or site manager permissions prior to filming.

  • For construction sites, the Client must confirm that the location is safe to access and that appropriate site inductions and safety requirements are met.

  • Scene By Studio reserves the right to refuse or postpone operations if conditions are deemed unsafe or non-compliant with CASA or Work Health and Safety (WHS) standards.

5. Deliverables and Turnaround

  • Final edited images and/or videos will be delivered via secure digital download or other agreed delivery methods.

  • Standard delivery timeframe is 7 business days following completion of the shoot, unless otherwise specified.

  • Rush delivery options may be available for an additional fee.

6. Copyright and Licensing

  • Copyright Ownership: All photographs, videos, and other creative materials produced by Scene By Studio remain the intellectual property of Scene By Studio and are protected under the Copyright Act 1968 (Cth).

  • License to Client: Upon full payment, the Client is granted a non-exclusive, perpetual, worldwide license to use the delivered content for commercial purposes, including marketing, real estate listings, social media, advertising, print, and online publication.

  • Restrictions:

    • The Client may not sell, resell, transfer, or sublicense the content to third parties without prior written consent.

    • The Client may not claim authorship or remove embedded metadata or watermarks without permission.

  • Moral Rights: Scene By Studio retains the right to be credited as the creator wherever reasonably possible.

7. Safety and Compliance

  • Drone operations will only proceed under conditions that comply with CASA regulations, including controlled airspace and line-of-sight restrictions.

  • Scene By Studio reserves the right to cancel or adjust flight plans due to weather, proximity to airports, or safety risks.

  • The Client acknowledges that safety takes precedence over specific shot requests.

8. Revisions and Additional Editing

  • One round of reasonable revisions or colour adjustments is included in the agreed project fee.

  • Additional editing, revisions, or alternate versions requested after delivery may incur an additional charge at our standard hourly rate.

9. Limitation of Liability

While every effort is made to deliver high-quality results, Scene By Studio is not liable for:

  • Delays caused by weather, regulatory restrictions, or third-party permissions

  • Loss or damage arising from equipment failure or flight cancellation

  • Indirect, incidental, or consequential losses related to the use of delivered content

The total liability of Scene By Studio under this Agreement shall not exceed the total amount paid by the Client for the specific project.

10. Confidentiality

All project information, footage, and materials shared by the Client are treated as confidential and will not be disclosed or reused without written consent, except for standard promotional purposes (e.g. portfolio, website, or social media use) unless otherwise requested in writing.

11. Governing Law

This Agreement is governed by the laws of Queensland, Australia, and any disputes shall be resolved in the courts of that jurisdiction.

12. Acceptance of Terms

By booking or engaging Scene By Studio, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
